By accessing or using MailFlow ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Use of Service

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Send spam or unsolicited bulk emails
  • Upload purchased, scraped, or harvested email lists
  • Use the Service to send malicious content, phishing emails, or malware
  • Attempt to reverse engineer, hack, or disrupt the Service
  • Violate any applicable laws or regulations (including CAN-SPAM, GDPR, CASL)
  • Impersonate another person or organization
  • Use the Service to send content promoting illegal activities

2. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account. Notify us immediately of any unauthorized use.

3. Email Marketing Compliance

By using our email sending features, you represent that:

  • You have obtained proper consent from all recipients
  • All emails include a working unsubscribe mechanism
  • All emails include your valid physical address
  • Your subscriber lists comply with applicable anti-spam laws

We reserve the right to suspend accounts that violate anti-spam policies or generate excessive bounce/complaint rates.

4. Plan Limits & Fair Use

Each plan includes defined limits (daily emails, subscribers, templates, forms). These limits are enforced automatically. Attempting to circumvent limits through technical means is a violation of these Terms.

5. Intellectual Property

The Service, including its design, code, and content, is owned by us and protected by intellectual property laws. You retain ownership of content you create and upload (email templates, subscriber data). You grant us a license to process this content solely to provide the Service.

6. Privacy

Your use of the Service is also governed by our Privacy Policy.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EMAILS WILL BE DELIVERED. EMAIL DELIVERABILITY DEPENDS ON MANY FACTORS OUTSIDE OUR CONTROL.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR BUSINESS OPPORTUNITIES.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any third-party rights.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms, non-payment, or any other reason at our discretion. You may terminate your account at any time by contacting us.
